Hello TITSRP Forums. On 9/4/23 I was warned for RDA by AflictoGaming. I would like to add some backstory & argue that I do not deserve this warn. As usual, I am a CP Main and patrol the streets for any criminals, and I ran into a player named Nutter. Nutter at the time had their huge sword swep out (https://cdn.discordapp.com/attachments/886173010426482730/1148375525073633422/image.png) and I figured I would perform a weapon check on this user. Of course, this user had a plethora of illegal weapons so I arrested them. Now, this is where it gets interesting and I can argue I had reasonable suspicion to weapon check Nutter. According to the rule: "Having a firearm without a license: If you are searched and possess a weapon without a license you can be arrested. Police may randomly search you if they have reason to believe you possess an unlicensed weapon" I can randomly search a player if I have reasonable suspicion they possess illegal/unlicensed weapons. AflictoGaming argues that since there was no law that SWEPS were illegal that it was RDA. He also mentions SWEPS are not illegal items, but this is where it gets very confusing. Sweps(Scripted WEAPONS) ARE illegal weapons/items according to these jobs: Alien - (https://cdn.discordapp.com/attachments/886063132760473640/1148379193059586068/image.png) (Kiss SWEP is an illegal weapon) Osiris - (https://cdn.discordapp.com/attachments/886063132760473640/1148379870431297536/image.png) (The Osiris cannot damage players to my knowledge) Mr. Sniffy - (https://cdn.discordapp.com/attachments/886063132760473640/1148380519877316769/image.png) (I assume Bleach is a SWEP and cannot damage players) Bounty Hunter - (https://cdn.discordapp.com/attachments/886063132760473640/1148381345324744814/image.png) (Bounty List is an illegal WEAPON?) Stalker - (https://cdn.discordapp.com/attachments/886063132760473640/1148380254243655782/image.png) (Undercover SWEP & Poop Thrower are illegal "weapons") Master Stalker - (https://cdn.discordapp.com/attachments/886063132760473640/1148495125887078400/image.png) (same as above) Bruce - (https://cdn.discordapp.com/attachments/886063132760473640/1148495506402721872/image.png) (Fidget spinner is obviously a swep, cannot damage players so I would not consider it a weapon) Knowing this information, My reasonable suspicion was to check Nutter to see if their Weapon shaped Sword SWEP was illegal, and as I did so I discovered many other illegal weapons (that i don't have a screenshot of) I'm curious to know what your guys thoughts are on this, thank you for you time! One can also say that not all sweps are illegal and you had no way to know if that one was illegal before weapon checking him. Also no law stated he needed a firearms license to hold this Huge Sword. Like I said as well though no law also stated you couldn’t have sweps out and the rules only state the sweps for those jobs and not every other job. Mild Tsunami Posted September 5, 2023 Share Posted September 5, 2023 I will have to +1 this report because I read the rule "Having a firearm without a license: If you are searched and possess a weapon without a license you can be arrested. Police may randomly search you if they have reason to believe you possess an unlicensed weapon" which means any cop can check any player at any time to see if they possess any weapons. When a cop is actively weapon checking a player they are KOS by the player they are checking so the player could have gotten out of it if they killed the cop. Which you did; I'm going to be +1 here. Just for future reference not saying you do this but if you see someone as a CC that doesn't mean you can just wep check em. riddim Posted September 5, 2023 Share Posted September 5, 2023 (edited) It's a default illegal activity that having an unlicensed weapon is an arrestable offense, but you need a valid reason to weapon check in the first place. Dev stated his reason for the weapon check was to see if the master sword was illegal, it just happens that Nutter had illegal weapons on him. The problem here more seems to be that some sweps show up as illegal weapons, the wording of “cops can weapon check with reasonable suspicion” can be twisted to CP advantage. There doesn't need to be a law in place for this to be arrestable, and since nobody is denying that the person who got arrested didn't have a swep out, Dev1 had the right to weapon check for more illegal weapons since one was being held out. The problem here more seems to be that sweps show up as illegal weapons, and Dev had knowledge of that so I don't think he is in the wrong here for arresting them. Simply put, don't have a weapon out OR kill the cop that weapon checked you. These situations can be dealt with through RP rather than calling a sit first. +1 for removal of warn He can’t kill the cop that weapon checks him if he is in cuffs before the weapon check. Did Dev cuff him before weapon checking? Seems like in the appeal he stated a weapon check before arresting. AflictoGaming Posted September 5, 2023 Share Posted September 5, 2023 (edited) After doing my own weapon searches on people with jump sweps that look like swords/spears and funny enough a tree none of these came back as illegal and none of these people had a firearms license. That means when you conducted your weapon search on Nutter for a illegal item that item didn't come back as illegal meaning you had no legal reason to weapon search him in the first place. Making it RDA. I am totally fine with making it a verbal but i will wait and see what everyone else says as im guessing you wouldn't be fine with a verbal either?
