If he doesnt come on hopefully you guys can decide to do it upon yourselves? Hes at fault if hes going to wrongly ban someone, then decide to be inactive. Sadly unless a admin or higher wants to give you the benefit of the doubt looks like you have to wait this one out. How much longer on your ban?
