I want to preface this by saying that I know this is an old ban, and quite honestly I have low expectations that anything could be done about it at this point. I just figured I might as well try to do something about it because having a heavy ban like this on my record doesn't sit right with me. Ideally I'd like this to get expunged off my record but at the very least I would just like to get some clarity/second opinions from other staff members about this situation.

My situation:
I was having some sort of dispute with a player, at this point I can't remember what but one way or another we ended up in at least 1 sit together throughout the night. Me and the other player were kinda going back and forth about the situation. BOT sittoandmori was the only attending staff member online at the time and was seemingly showing some noticeable bias towards the other player. The perceived unfairness was frustrating, and I said something to the other player to the effect of "stop sucking the mods dick to win all your sits". The staff member then said they were a minor and then promptly gave me a 2 week ban. I know my comments were a bit much, however I didn't know BOT sittoandmori, and I certainly didn't know he was a minor when I said that. If I had known that ahead of time I would have behaved differently. I also feel like due to there being no way I would have known he was a minor, an instant 2 week ban was rather unwarranted, as similar comments are thrown around on this server very commonly. If I had simply been told "hey im a minor, please don't make comments like that" I would've changed my approach instantly, however there was absolutely 0 leeway given.

I've been playing on the server off and on since 2017, and apart from this PTOX ban I have nothing really visible on my record apart from 2 warns in the past 7 years. I also have no history of PTOX at all, which makes me question further why a 2 week ban was the first choice of addressing this situation. Until recently I had forgotten about the situation almost entirely, and what mainly prompted this post was a similar situation I was reading about on the forums recently:

I will preface by saying, I think the person appealing in this other forum post is in the wrong, however when reading it there were a few things similar to my situation that stuck out to me. The first being the player perceiving a bias from BOT sittoandmori. While there is definitely a large degree of discretion that is given to staff members within sits, I found it interesting that this other player had the exact same issue of this staff member favoring one party over the other. Secondly, the reasoning for the ban was similar. This player did not know Sitto was a minor, and they were punished as if the comments were made intentionally to sexualize a minor. Thirdly, the player in this situation also echoed that he was given no chance to change his behavior before being banned. Additionally, it should be noted that this player already had 3 priors on their record for PTOX prior to this situation and also was warned earlier in the night to not make those comments, and ONLY RECEIVED A ONE WEEK BAN. I received a two week ban instantly with 0 priors on my record and 0 warning.

Again, I know this ban has been concluded for a while, but upon reading about this other situation, I find it quite distasteful having a PTOX ban on my virtually spotless record for the last 7 years. I regret how I acted, however I don't think an instant 2 week ban on my record with no chance for recourse was a fair punishment. I don't have any screenshots of the incident, and I noticed that this staff member has since received a community removal for whatever reason, however if staff would like to cross reference this with whatever was in logs for the night, I would be happy to back up anything said here.

While this really should've only resulted in a warn ( imo ), the note he left said you showed no regret in the sit. You still said what you said, and you shouldn't say stuff like that to people you don't know the age of. While I don't fully agree with the punishment length given, it's fully up to the banning staff member to decide that off of our Punishment Guidelines. 

 

Sitto has since been comm removed and has deleted everything to do with the server, so there's no way to gather the evidence he had for the ban back then.

 

If you would've appealed back then I most likely would've voted in your favor, but as of now I don't really see a reason to remove the ban or switch it to a warn. -1

I'd honestly be willing to +1 for ban removal due to the despicable and hypocritical things that the banning staff member has said since being banned, idk depends how staff feel.

You don't remove punishments just because someone got Comm Removed and did a full 180. 

 

I would be more than happy to vote in favor to remove this, however you need to have evidence of what you said actually happening. We cannot in good faith go of 'he said she said'. 

 

Aa for as logs go, you may also have your own version of the logs, I'll find out where user logs export to and either edit this or PM you. Sitto has obviously been Comm removed and has nothing to do with Tits as shown by his actions, I doubt he will still have any TitsRP evidence logs/clips.

I agree that a comm removal doesn’t negate his judgement on the situation, however I do feel it highlights the character of the staff member and I feel like that should be taken into account. I am not the first person to report this exact scenario of bias + seemingly retaliatory ban.
 

I would also like to highlight that the note for “lack of remorse” consisted of me making the exact same point I am now, that what I said was clearly not meant to accuse and sitto was reaching for a reason to ban. What I said was not public, it was done in local chat between 2 parties that were directly involved in the situation, and the comment wasn’t even made directly to sitto, my comments were shitty but I think saying that I was trying to accuse is a bit of a reach. It seems very odd that this happened almost exactly the same in the other forum post i provided, I feel like there is a clear behavior pattern here.

 

again, I’ll provide whatever logs I can when I’m directed on where to find them. I don’t know what exactly can be found in the logs on either end, but finding the name of the other player involved in the incident could be helpful.

Only issue is if this was a VC conversation in the sit we would need a clip for obvious reasons however I do see where you are coming from. I do think a ban for that is egregious a warn would have sufficed at most. The issue stems from the fact that Sitto is no longer in the community and just because he has shown his true colors we can't negate all player bans and warns. What he banned you for - if true is a false ban in my opinion and should be changed to a note considering it was not even an accusation. 

 

Like I said though, unfortunately for all appeals and reports we need evidence, if this was a VC sit we would need a clip. Character judgement as well, I have yet to see you cause any trouble since I have been back on Tits, I have also yet to see any staff have any issues with you as well.

 

Can you see if your logs are saved in - C:\Program Files (x86)\Steam\steamapps\common\GarrysMod\garrysmod\data\slogs-saved-logs

Ive been in vc with this exact scenario with him if I could find a clip to help your case I would however in my searches of my entire medal library I have not been able to find as such, I wish you luck on finding the logs and I hope you do get this sorted out, though you should have appealed at the time rather than a few months later to make this much easier.

Yeah it appear my logs folder is empty. Honestly figured as much given how long ago it was. If any staff have access to logs from then I would appreciate if that could be pulled from ~15mins before my ban, however apart from that all I can really do is hope y'all will consider sitto's track record and reputation for this kind of thing. As far as logs go, seeing who the other person in the sit was could be helpful, as the name hoodwinked from the other report looks familiar. Either way, thank yall for the input on the matter, as at least hearing how unreasonable the punishment was makes it a bit more palatable.
